Forthwith LLC
Terms of Service
These Terms govern your use of Forthwith's website, hosted dashboard, and API services. The downloadable CLI application is covered separately by the Forthwith CLI License Terms. Effective date: March 13, 2026.
1. Acceptance and eligibility
By accessing or using Forthwith, you agree to these Terms. If you use the service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
You may use Forthwith only if you can form a binding contract with us and your use complies with applicable law.
2. The service
Forthwith provides a localization workflow that helps you identify user-facing strings, send selected text to third-party large language model providers for translation, and write translated output back into your project files.
The hosted service may include websites, APIs, dashboards, and beta or preview features.
The downloadable Forthwith CLI application is licensed separately. View the Forthwith CLI License Terms
3. Accounts and organization access
You are responsible for maintaining the security of your account credentials, API tokens, local CLI sessions, and devices.
You are also responsible for activity that occurs through your account or organization, including actions taken by team members, contractors, or anyone who uses your credentials or organization access.
4. Your content and permissions
You retain ownership of the text, files, prompts, configuration, and other content you submit to Forthwith, along with the translated output returned to you.
You give Forthwith a limited right to host, copy, transmit, process, and modify that content only as needed to operate, secure, support, and improve the service.
You represent and warrant that you have all rights, permissions, and legal bases needed to submit the content you send to Forthwith and to instruct us to process it.
5. Translation output, review, and your responsibility
Forthwith uses machine-generated translation systems. We do not guarantee that any translation will be accurate, complete, lawful, non-infringing, properly localized, culturally appropriate, or fit for your use case.
You are solely responsible for reviewing, testing, approving, and deciding whether to use any translation, file change, terminology choice, formatting change, or localization output generated through the service.
You must not rely on Forthwith as a substitute for human review where errors could create legal, financial, safety, medical, regulatory, employment, accessibility, or customer-support risk.
6. No liability for translations or their consequences
To the maximum extent permitted by law, Forthwith LLC is not responsible or liable for the quality, accuracy, completeness, legality, usefulness, or fitness of any translation or localization output generated through the service.
This limitation applies to any negative effect arising from bad or incomplete translations, including product defects, misleading copy, offensive language, failed releases, customer claims, lost revenue, data loss, compliance issues, or third-party disputes.
If you choose to merge, distribute, publish, or otherwise rely on translated output, you do so at your own risk.
7. Acceptable use
You may not use Forthwith to violate the law, infringe intellectual property or privacy rights, interfere with the service, bypass rate limits or security controls, or submit malicious code or abusive workloads.
You should not submit highly sensitive or regulated data unless you have independently determined that doing so is appropriate and lawful for your use case.
8. Fees, billing, and taxes
Paid features are billed according to the pricing, usage metrics, and plan terms presented to you at signup, in-product, or on our pricing pages.
You authorize us and our payment processor to charge the payment method associated with your account for recurring fees, usage-based charges, applicable taxes, and any other amounts you agree to pay.
Unless otherwise stated, fees are non-refundable. We may suspend or limit access if payment fails or your account becomes delinquent.
9. Third-party providers
Forthwith relies on third-party service providers, including payment processors, analytics providers, email infrastructure, hosting providers, and large language model providers that generate translations.
Your use of integrated third-party services may also be subject to those providers' terms or policies.
10. Availability, beta features, and changes
We may modify, improve, suspend, or discontinue any part of the service at any time. Beta, preview, or early-access features may be incomplete, unstable, or changed without notice.
We are not liable for downtime, delays, lost work, or unavailable features.
11. Warranty disclaimer
Forthwith is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
12. Limitation of liability
To the maximum extent permitted by law, Forthwith LLC and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity arising from or related to the service.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the service will not exceed the greater of the amount you paid Forthwith for the service in the twelve months before the event giving rise to the claim or one hundred U.S. dollars (US $100).
13. Suspension and termination
You may stop using Forthwith at any time. We may suspend or terminate access if we believe you breached these Terms, created risk for the service or others, failed to pay amounts due, or if continued service is no longer commercially practical.
Sections that by their nature should survive termination will survive, including sections about ownership, disclaimers, liability limits, payment obligations, and dispute-related matters.
14. General terms
We may update these Terms from time to time by posting a revised version on this page. Continued use of the service after the revised Terms become effective means you accept the updated Terms.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect.
Questions about these Terms may be sent to development@forthwith.dev.
